Terms & Conditions

Version: ۲.۱Last Updated: ۴ شهریور ۱۴۰۵

1. Acceptance of these terms

Banafsh is an AI chat and API service. By creating an account, signing in, or using any part of the service, you agree to these terms. If you do not agree, do not use the service.

This is version 2.1. The date it last changed appears at the top of this page.

2. What the service is

Banafsh lets you chat with language models and, through an API key, use those same models in your own tools. Your messages are processed by model providers; the Privacy Policy explains this.

We may change features, available models and limits over time.

3. Your account

You sign in with a mobile number and a one-time code. Keeping access to that number, and to your account, is your responsibility.

You must have legal capacity to use the service. If you are under 18, you may use it only with the permission of a legal guardian.

The information you give when registering must be accurate.

4. Acceptable use

Your use of Banafsh must comply with the laws and regulations of the Islamic Republic of Iran.

The following are prohibited: criminal activity; producing or distributing harmful or unlawful content, or content that violates the privacy of others; attempting to circumvent usage limits, quotas or security mechanisms; bulk automated access outside an API key; and reselling or transferring your access to others without our written agreement.

You are responsible for what you send to the service and for what you do with its output.

5. API keys

An API key stands for your account. Any usage made with your key is billed to you — including usage by someone else who has obtained it.

Keep your key secret, never commit it to a public repository, and if you believe it has been exposed, revoke or replace it immediately from the connect page.

6. AI output

Generated responses may be inaccurate, incomplete or misleading. Do not treat them as legal, medical, financial or other professional advice.

Verify anything you intend to rely on. A decision you make based on the service's output is your decision.

Output may be similar for different users; we make no claim that it is unique or exclusive to you.

7. Your content

What you put in remains yours. You give us permission to process it, and — if chat history is on — to store it, solely in order to provide this service.

We do not use the content of your chats to train models.

8. Credit, payment and subscriptions

Your wallet is funded with top-up codes. Each request is charged against it based on actual usage at the prices published on the pricing page.

Some plans are offered as recurring subscriptions and may include a free trial period. A trial is available to each user only once.

Purchased credit is not convertible to cash. If an error on our side caused an incorrect charge, we will return the equivalent to your wallet once reviewed. Contact us to raise such a case.

Prices may change. A price change does not affect credit already consumed.

9. Usage limits

To keep the service stable and prevent abuse, we apply rolling usage caps and concurrency limits.

If you exceed a cap, your keys may be temporarily suspended until the window resets.

10. Suspension, termination and closing your account

If you breach these terms, or your use threatens the security or stability of the service, we may suspend your access or close your account.

You can close your own account at any time from Settings inside the app. This ends your access immediately, deletes your chats and attachments right away, and revokes your API keys.

Any wallet balance you hold at closure is frozen — not refunded and not immediately zeroed. It can only be restored by contacting support to reopen the account within 180 days of closure; after that window, it is written off to zero.

Reopening a closed account is available only by contacting support — there is no self-service way back in.

A reopened account does not get its deleted chats back, and does not receive a second welcome credit.

11. Availability

The service is provided “as is”. We do not warrant that it will be uninterrupted, error-free, or fit for your particular purpose.

It may be unavailable for maintenance or for reasons outside our control.

12. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, or loss of profit.

In any event, our total liability for any claim is limited to the amount you paid Banafsh in the three months before that claim arose.

13. Changes to these terms

We may update these terms. Any material change raises the version number, and you will be asked to accept the new version the next time you sign in.

Continuing to use the service after accepting means you agree to the new version.

14. Governing law

These terms are governed by the laws of the Islamic Republic of Iran, and disputes fall within the jurisdiction of the Iranian courts.
